New Charges filed against against Defendants in SIPT Trial

Following the death of Justice Paul Harrison and the decision by the  Director of Public Prosecutions , Queen’s Counsel Eugene Otuonye, the Special Investigaton and Corruption Team (SIPT) corruption trial is expected to begin afresh unless defence lawyers are sucessful in their abuse of process and constitutional motions to be heard by Chief Justice Mabel Agyemang on March 25th, 2021.

The new charges were filed against the following defendants: Michael Misick, Floyd Hall, McAllister Hanchell, Jeffrey Hall, Clayton Greene, Thomas Chalmers (“Chal”) MIsick and Melbourne Wilson.

They were charged with the following offences:

COUNT 1.

STATEMENT OF OFFENCE – (BRIBERY)

PARTICULARS OF OFFENCE – MICHAEL EUGENE MISICK and FLOYD BASIL HALL between the 1st August 2003 and the 30th November 2008 accepted inducements directly or indirectly from Peter Wehrli and/or related and connected entities by unlawful corrupt payments or other rewards (in the form of cash, credit, entertainment and other advantages), whilst serving as a Minister of the Crown in the Government of the Turks and Caicos Islands so that he would act in a way that was contrary to the ordinary rules of honesty and integrity expected of Ministers of the Crown.

COUNT 2.

STATEMENT OF OFFENCE – (CONSPIRACY TO DEFRAUD)

PARTICULARS OF OFFENCE – MICHAEL EUGENE MISICK, FLOYD BASIL HALL and McALLISTER EUGENE HANCHELL between the 1st August 2003 and the 31st day of December 2008, conspired together and with others to defraud the Crown, the Government of the Turks and Caicos Islands and/or the Belongers, by arranging the transfer of Crown Land at Water Cay on terms that were contrary to the economic interests of the Crown, the said Government of the Turks and Caicos Islands and/or the said Belongers.

COUNT 3.
STATEMENT OF OFFENCE – (BRIBERY)

PARTICULARS OF OFFENCE – MICHAEL EUGENE MISICK and FLOYD BASIL HALL between the 1st day of August 2003 and the 31st day of December 2007 accepted inducements directly or indirectly from Jak Varet Civre and/or related and connected entities by unlawful corrupt payments or other rewards (in the form of cash, credit, entertainment and other advantages), whilst serving as a Minister of the Crown in the Government of the Turks and Caicos Islands so that he would act in a way that was contrary to the ordinary rules of honesty and integrity expected of Ministers of the Crown.

COUNT 4.

STATEMENT OF OFFENCE – (CONSPIRACY TO DEFRAUD)

PARTICULARS OF OFFENCE – MICHAEL EUGENE MISICK, FLOYD BASIL HALL, JEFFREY CHRISTOVAL HALL and MELBOURNE ARTHUR WILSON between the 1st day of January 2004 and the 30th day of June 2006, conspired together with Lillian Boyce, Samuel Ernest Been, Quinton Albert Hall and Earlson Mcdonald Robinson to defraud the Crown, the Government of the Turks and Caicos Islands and/or the Belongers, by arranging the transfer of Crown Land at North West Point on terms that were contrary to the economic interests of the Crown, the said Government of the Turks and Caicos Islands and/or the said Belongers.

STATEMENT OF OFFENCE – (BRIBERY)

PARTICULARS OF OFFENCE – MICHAEL EUGENE MISICK between the 1st day of June 2004 and the 31st day of March 2007 accepted inducements directly or indirectly on behalf of the Beaches Group (including Gordon Arthur Stewart) by unlawful corrupt payments or other rewards (in the form of cash, credit, entertainment and other advantages), whilst serving as a Minister of the Crown in the Government of the Turks and Caicos Islands so that he would act in a way that was contrary to the ordinary rules of honesty and integrity expected of Ministers of the Crown.

COUNT 6.

STATEMENT OF OFFENCE – (BRIBERY)

PARTICULARS OF OFFENCE – MICHAEL EUGENE MISICK, FLOYD BASIL HALL and McALLISTER EUGENE HANCHELL between the 1st January 2005 and the 30th day of January 2009 accepted inducements directly or indirectly from Mario Hoffman and/or related and connected entities by unlawful corrupt payments or other rewards (in the form of cash, credit, entertainment and other advantages), whilst serving as a Minister of the Crown in the Government of the Turks and Caicos Islands so that he would act in a way that was contrary to the ordinary rules of honesty and integrity expected of Ministers of the Crown.

COUNT 7.

STATEMENT OF OFFENCE – (BRIBERY)

PARTICULARS OF OFFENCE – MICHAEL EUGENE MISICK and FLOYD BASIL HALL between the 1st day of August 2003 and the 31st day of August 2009 accepted inducements directly or indirectly from Richard Padgett and related and connected entities by unlawful corrupt payments or other rewards (in the form of cash, credit, entertainment and other advantages), whilst serving as a Minister of the Crown in the Government of the Turks and Caicos Islands so that he would act in a way that was contrary to the ordinary rules of honesty and integrity expected of Ministers of the Crown.

COUNT 8.

STATEMENT OF OFFENCE – (BRIBERY)

PARTICULARS OF OFFENCE – MICHAEL EUGENE MISICK and McALLISTER EUGENE HANCHELL between the 1st day of November 2006 and the 1st day of May 2008 accepted inducements directly or indirectly from the Logwood Development Company and related and connected entities (including Harold Charles, Alan Lisenby, Matt McDonald and Scott Boatman) by unlawful corrupt payments or other rewards (in the form of cash, credit, entertainment and other advantages), whilst serving as a Minister of the Crown in the Government of the Turks and Caicos Islands so that he would act in a way that was contrary to the ordinary rules of honesty and integrity expected of Ministers of the Crown.

COUNT 9.

STATEMENT OF OFFENCE – (CONSPIRACY TO DEFRAUD)

PARTICULARS OF OFFENCE – MICHAEL EUGENE MISICK, FLOYD BASIL HALL, McALLISTER EUGENE HANCHELL and THOMAS CHALMERS MISICK between the 1st day of January 2006 and the 31st day of December 2008, conspired together with Lillian Boyce and others to defraud the Crown, the Government of the Turks and Caicos Islands and/or the Belongers, by arranging the transfer of Crown Land at West Caicos on terms that were contrary to the economic interests of the Crown, the said Government of the Turks and Caicos Islands and/or the said Belongers.

COUNT 10.

STATEMENT OF OFFENCE – (CONCEALING OR DISGUISING THE PROCEEDS OF CRIMINAL CONDUCT contrary to section 30 (2)(a) of the Proceeds of Crime Ordinance1998)

PARTICULARS OF OFFENCE – CLAYTON STANFIELD GREENE between the 1st day of January 2006 and the 31st day of August 2009 concealed or disguised the proceeds of criminal conduct knowing or having reasonable grounds for suspecting it to represent in whole or in part directly or indirectly the proceeds of criminal conduct committed by Floyd Basil Hall, with a view to avoiding the making or enforcement of a confiscation order or avoiding prosecution for unlawful conduct.

COUNT 11.

STATEMENT OF OFFENCE – (CONCEALING OR DISGUISING THE PROCEEDS OF CRIMINAL CONDUCT contrary to section 30 (2)(a) of the Proceeds of Crime Ordinance 1998)

PARTICULARS OF OFFENCE – THOMAS CHALMERS MISICK between the 1st day of August 2003 and the 31st day of August 2009 concealed or disguised the proceeds of criminal conduct knowing or having reasonable grounds for suspecting it to represent in whole or in part directly or indirectly the proceeds of criminal conduct committed by Michael Eugene Misick, with a view to avoiding the making or enforcement of a confiscation order or avoiding prosecution for unlawful conduct.

COUNT 12.

STATEMENT OF OFFENCE – (CONCEALING OR DISGUISING THE PROCEEDS OF CRIMINAL CONDUCT contrary to section 30(2)(a) of the Proceeds of Crime Act 1998)

PARTICULARS OF OFFENCE – THOMAS CHALMERS MISICK between the 1st day of August 2003 and the 31st day of August 2009 concealed or disguised the proceeds of criminal conduct knowing or having reasonable grounds for suspecting it to represent in whole or in part directly or indirectly the proceeds of criminal conduct committed by McAllister Eugene Hanchell, with a view to avoiding the making or enforcement of a confiscation order or avoiding prosecution for unlawful conduct.

COUNT 13.

STATEMENT OF OFFENCE – (CONSPIRACY TO DISGUISE THE PROCEEDS OF CRIME)

PARTICULARS OF OFFENCE – MICHAEL EUGENE MISICK and FLOYD BASIL HALL between the13th June 2002 and the 31st day of August 2009 conspired together to disguise the proceeds of crime namely bribes, as payments to the Progressive National Party Accounts which were purported to be political donations and paid into the said Progressive National Party account but were used for the personal benefit of the said Michael Eugene Misick and Floyd Basil Hall and others with a view to avoiding the making or enforcement of a confiscation order or avoiding prosecution for unlawful conduct contrary to section 30 of the Proceeds of Crime Ordinance 1998
